The holidays are a special time to get engaged. Festive decorations, family gatherings and cozy intimate moments. You will be busy picking the special place and time, shopping for the perfect ring, and thinking about involving the family, or not J
As a medically trained family law attorney/mediator, I would also like you to think about something else. Yes, a prenuptial agreement.
It’s important to start any marital journey on the right foot. It’s not all about the glitz and glamour, but also about the nuts and bolts.
I tell couples in my family law practice to start their marriage on a healthy path, both emotionally and practically, it’s important to begin with transparency.
A prenuptial agreement may seem unromantic, but it’s actually a great way to begin your marriage with honesty. A prenuptial agreement gives you the opportunity to protect both parties’ assets and ensure that you are both on the same page about financial responsibilities, and to be prepared just in case of divorce.
So, What is a prenuptial agreement?
It’s a legal document that outlines how a couple’s assets and debts will be divided in case of divorce or death. It can also cover things like inheritance, business ownership, preparing for children, and making provisions in the event of divorce. It can also protect both parties’ financial future and incomes. You can define what will happen to assets acquired before and during the marriage. And if one person has significant debt (i.e., student loans, business debt), the agreement can insure the other spouse is not liable for it. A prenuptial agreement can also simplify a divorce. Having a prenup can significantly reduce legal battles and costs, as well as stress.
It’s also important to note, prenuptial agreements are not just for the wealthy. This is a big misconception. Even couples with modest assets can benefit especially if there are significant differences in income, business interests and debt.
Crafting a prenuptial agreement is not about distrust, it is about thoughtfully planning your future. It’s not preparing for a marriage to fail, it’s preparing for a marriage to prosper. It’s a proactive planning process that can prevent conflict in the future by addressing important life issues upfront.
I always encourage couples embarking on the magical journey of marriage to have a conversation early. It’s ideal to do so during the engagement period so emotions don’t run high closer to the wedding day. I suggest couples approach this important conversation with affection and love.
