What Is a Postnuptial Agreement?
A postnuptial agreement is a legally binding contract between two spouses that is created after they are already married. Like a prenuptial agreement, this contract would be used to settle the couple’s affairs and assets in the event of a divorce or separation. It may spell out how the couple’s property will be divided, who will get custody of the children, how much spousal support will be awarded, etc. When creating a postnuptial agreement, both spouses should hire their own legal representation.
Why Would a Married Couple Create a Postnuptial Agreement?
